Privacy Policy

1. Introduction

Aescape, Inc. (“Aescape,” “we,” “us,” or “our”) builds data-driven massage experiences. This Privacy Policy describes how we collect and use personal information from our business customers (our “Partners”) and their clients and guests who enjoy a massage experience (“Members”). Individuals may also interact with us through our application (the “App”). This Privacy Policy also describes how we interact with individuals who visit our public website (www.aescape.com) and social media pages (together, the “Sites”).

2. Personal Information We Collect

Information from Partners. Personal information we may receive from Partners includes:

  • Contact data such as company name, employee names, employee email addresses, business mailing addresses, employee professional titles, and business phone numbers.

  • Transactional data such as information related to Members’ particular massage experience.

  • Payment data such as bank account information needed to pay Partners for Member massages.

  • Other data not specifically listed here, which we will use as described in this Privacy Policy or as otherwise disclosed at the time of collection.

Information from Members. Personal information we may receive from Members when they set up an account on the App and enjoy a massage experience includes:

  • Profile data such as name, mailing address, gender, date of birth, email address, phone number, online account credentials, and any other information you add to your account profile on the App. This may include information about you provided by Partners.

  • Massage data such as information used to schedule massage appointments (including date and location of massages, order numbers, and transaction history), massage type and duration, massage preferences, preferred Partners, massage location, and other information needed to personalize your massage experience.

  • Body scans collected in a “point cloud” format during a massage. We do not collect a scan of facial geometry, fingerprints, or palm scans.

  • Marketing data such as your preferences for receiving our marketing communications and details about your engagement with them, which may be used for promotional purposes.

  • Payment data such as credit card information needed to complete transactions in the App.

  • Other data not specifically listed here, which we will use as described in this Privacy Policy or as otherwise disclosed at the time of collection.

Automatic Data Collection. We and/or our service providers may automatically log information about you, your computer or mobile device, and your interaction over time with the App and the Sites, our communications, and other online services, such as:

  • Device data such as your computer or mobile device’s operating system type and version, manufacturer and model, browser type, screen resolution, RAM and disk size, CPU usage, device type (e.g., phone, tablet), IP address, unique identifiers (including identifiers used for advertising purposes), language settings, mobile device carrier, radio/network information (e.g., Wi-Fi, LTE, 3G), and general location information such as city, state, or geographic area.

  • Online activity data such as pages or screens you viewed, how long you spent on a page or screen, the website you visited before browsing to the Sites or the App, navigation paths between pages or screens, information about your activity on a page or screen, access times and duration of access, and whether you have opened our emails or clicked links within them.

Cookies and similar technologies. Some of the automatic collection described above is facilitated by the following technologies:

  • Cookies, which are small text files that websites store on user devices and that allow web servers to record users’ web browsing activities and remember their submissions, preferences, and login status as they navigate a site. Cookies used on the Sites include both “session cookies” that are deleted when a session ends, “persistent cookies” that remain longer, “first party” cookies that we place, and “third party” cookies that our third party business partners and service providers place.

  • Web beacons, also known as pixel tags or clear GIFs, which are used to demonstrate that a webpage, screen, or email was accessed or opened, or that certain content was viewed or clicked.

  • Software Development Kits (“SDKs”). We may use third party software development kits in our mobile and web applications. A SDK is third party computer code that may be used for a variety of purposes, including to provide us with analytics regarding the use of our mobile applications, to integrate with social media, add features or functionality to the App, or to facilitate online advertising. SDKs may enable third parties to collect information directly via the App.

Data about others. We may offer features that help users invite their friends or contacts to visit the Sites, create an account on the App, or check out our massage services, and we may collect contact details about these invitees so we can deliver their invitations. Please do not refer someone to us or share their contact details with us unless you have their permission to do so.

3. How We Use Your Personal Information

We may use your personal information for the following purposes or as otherwise described at the time of collection:

Provide and improve our Services. We may use your personal information to:

  • provide, operate, and improve the Sites, the App, our massage services, and our business;

  • personalize the Sites, the App, and our massage services, including remembering the devices from which you have previously logged in and remembering your massage selections and preferences;

  • establish and maintain your Partner or Member profile on the App;

  • facilitate your invitations to friends who you want to invite to become Members;

  • facilitate social features of the Sites, such as by identifying and suggesting connections with other users of the Sites and providing chat or messaging functionality;

  • enable security features of the Sites and the App, such as by sending you security codes via email or SMS, and remembering devices from which you have previously logged in;

  • communicate with you about the Sites and our massage services, including by sending related announcements, updates, marketing promotions, security alerts, and support and administrative messages;

  • communicate with you about events or contests in which you participate; and

  • provide support for the Sites, the App, and our massage services, and respond to your requests, questions, and feedback.


Research and development. We may use your personal information for research and development purposes, including to analyze and improve the Sites, the App, our massage services, and our business and to develop new products and services. As part of these activities, we may create aggregated or deidentified data from personal information we collect.


Marketing and advertising. We and our third party advertising partners may collect and use your personal information for marketing and advertising purposes:

  • Direct marketing. We and our third party advertising partners may send you direct marketing communications and may personalize these messages based on your needs and interests, including sending you marketing communications for non-Aescape products and services. You may opt out of our marketing communications as described in Section 5 (Opt out of marketing communications) below.

  • Interest-based advertising. Our third party advertising partners may use cookies and similar technologies to collect information about your interaction (including the data described in the automatic data collection section above) with the Sites, our communications, and other online services over time, and use that information to serve online ads they think will interest you. This is called interest-based advertising. We may also share information about our users with these companies to facilitate interest-based advertising to those or similar users on other online platforms.

Compliance and protection. We may use your personal information to:

  • comply with applicable laws, lawful requests, and legal processes, such as to respond to subpoenas, investigations, or requests from government authorities;

  • protect our, your, or others’ rights, privacy, safety, or property (including by making and defending legal claims);

  • audit our internal processes for compliance with legal and contractual requirements or our internal policies;

  • enforce the terms and conditions that govern the Sites, the App, and massage services; and

  • prevent, identify, investigate, and deter fraudulent, harmful, unauthorized, unethical, or illegal activity, including cyberattacks and identity theft.


Analytics. We may use analytics services, including Google Analytics, to assist us with analyzing the Sites or App traffic through cookies and similar technologies, including by collecting device data, purchase data, click data, and scroll time data, along with other datapoints. With your consent. In some cases, we may specifically ask for your consent to collect, use, or share your personal information, such as when required by law.


Retention. We generally retain personal information for the period of time needed to fulfill the purposes for which we collected it or where needed for legal, accounting, or reporting requirements, to establish or defend legal claims, or for fraud prevention purposes.


4. How We Share Your Personal Information

We may share your personal information with the following parties and as otherwise described in this Privacy Policy, in other applicable notices, or at the time of collection.


  • Affiliates. Our corporate parent, subsidiaries, and affiliates.

  • Partners. The companies that work with us to offer our massage services to their clients and guests. This includes companies with which we may co-sponsor events or promotions, and jointly offer products or services.

  • Service providers. Third parties that provide services on our behalf or help us operate the Sites and the App or our business (such as hosting, information technology, research and development, payment processing, customer support, email delivery, marketing, consumer research, and website analytics).

  • Advertising partners. Third party advertising companies for the interest-based advertising purposes described above.

  • Professional advisors. Professional advisors, such as lawyers, auditors, bankers, and insurers, where necessary in the course of the professional services they render to us.

  • Authorities and others. Law enforcement, government authorities, and private parties, as we believe in good faith to be necessary or appropriate to comply with applicable laws.

  • Business transferees. We may disclose personal information in the context of a potential or actual business transaction, such as investments in Aescape or sale, transfer, or merger of all or part of our business or assets.

We make commercially reasonable efforts to verify the parties with whom we share information provide a level of protection of personal information consistent with the practices described in this Privacy Policy, except that all such parties described above other than service providers and affiliates may, to the extent permitted by law, use personal information as described in their own privacy policies.

5. Your Choices

Access or update your information. If you have registered for an account with us through the App, you may review and update certain personal information by logging into your account. If you need assistance accessing your account or updating certain personal information in your account, please contact us.


Opt out of marketing communications. You may opt out of marketing-related emails by following the opt-out or unsubscribe instructions at the bottom of the email, or by contacting us. Even if you opt out of marketing-related emails, you may continue to receive service-related and other non-marketing emails.


Cookies. Most browsers let you remove or reject cookies. To do this, follow the instructions in your browser settings. Many browsers accept cookies by default until you change your settings. Please be aware that if you set your browser to disable cookies, the Sites and the App may not work properly.


Advertising choices. You may be able to limit use of your information for interest-based advertising through the following settings/options/tools:


  • Platform settings - Google and Facebook, for example, offer opt-out features that let you opt out of use of your information for interest-based advertising.

  • Ad industry tools - Opting out of interest-based ads from companies that participate in the following industry opt-out programs:

  • Mobile settings - Using your mobile device settings to limit use of the advertising ID associated with your mobile device for interest-based advertising purposes.


You will need to apply these opt-out settings on each device and browser where you want to limit the use of your information for interest-based advertising purposes. We cannot offer any assurances as to whether the companies we work with participate in the opt-out programs described above.


Delete Your Account and Data. You have the right to request deletion of your Aescape account within the App. To do this, please sign into your account on the App and follow instructions to delete your account. If you have not created an Aescape account within the App and would like to submit a data deletion request, please contact us. 

6. Other Sites and Services

The Sites may contain links to websites, mobile applications, and other online services operated by third parties. Sometimes, our content may be integrated into web pages or other online services that are not associated with us. These links and integrations are not an endorsement of, or representation that we are affiliated with, any third party. We do not control websites, mobile applications, or online services operated by third parties, and we are not responsible for their actions. We encourage you to read the privacy policies of the other websites, mobile applications, and online services you use.


7. Security

We employ reasonable and appropriate technical, organizational, and physical safeguards designed to protect the personal information we collect. However, security risk is inherent in all internet and information technologies, and we cannot guarantee the security of your personal information.

8. International Data Transfer

We are headquartered in the United States and may use service providers that operate in other countries. Your personal information may be transferred to the United States or other locations where privacy laws may not be as protective as those in your state, province, or country. You consent to the transfer and storage of your information in the United States or other countries.

9. Children

The Sites, the App, and our services are not directed to children and not intended for use by anyone under 18 years of age. If you are a parent or guardian of a child from whom you believe we have collected personal information in a manner prohibited by law, please contact us at legal@aescape.com. If we learn that we have collected personal information through the Sites or the App from a child without the consent of the child’s parent or guardian as required by law, we will use our best efforts to delete the information.

10. Changes to this Privacy Policy

We may change this Privacy Policy from time to time. Any changes will be effective upon our posting the modified version (or as otherwise indicated at the time of posting). In all cases, if you use the Sites, the App, or the services after the effective date, that means you have acknowledged the modified Privacy Policy applies.
